Duke Energy large load tariff settlement before North Carolina regulators draws objections
A settlement just filed by Duke Energy on its large load tariff is before the North Carolina Utilities Commission. The settlement was first made public October 6, and SELC says the proposal fails to hold data centers accountable.
Why it matters. The settlement sets the terms data centers would pay for Duke Energy power in North Carolina. Critics say large customers could pay only 25% of remaining electricity costs for years.

2Deals, Capital & Energy Agreements
BKV signs hyperscaler-backed supply contract for 1,200 megawatts of power generation equipment for Texas project
A BKV subsidiary "has executed an equipment supply contract" for "approximately 1,200 megawatts of power generation equipment" for "the Company's prospective power generation project in Texas". The release says the order comes "with deliveries beginning in September 2028".
Why it matters. A hyperscaler is carrying much of the early cost risk: "The backstop agreement covers approximately 90% of the payments owed by BKV through March 31, 2027". The release names the backer only as "a Leading Investment-Grade Hyperscaler" and does not name the equipment supplier.

3Policy & Regulation
San Francisco approves 45-day moratorium on new data center construction
San Francisco on October 6 approved a 45 day moratorium on new data center construction. Oakland and Los Angeles County are evaluating similar proposals, the station reports.
Why it matters. It is a binding pause in a major California city. Supervisor Shamann Walton noted the pause allows the city time.
